Plan It Focus Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Plan It Focus Sites and Service. Plan It Focus is a brand name of Finn Advisor, LLC, doing business as Plan It Focus ("Plan It Focus," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms and our Privacy Policy.
1) Eligibility
You may use the Service only if you can form a binding contract with us and are not prohibited from using the Service under applicable law.
You must be at least 13 years old to use the Service.
2) Your Account and Security
To use many features, you must create an account and Sign in. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3) Your Content
"User Content" means information and content you submit to the Service, including tasks, lists, goals, notes, appointments, and content submitted through integrations or AI features.
You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide license to host, store, back up, reproduce, and process your User Content solely to provide, operate, secure, and support the Service and as described in our Privacy Policy.
4) AI Features (AI Coach and Overwhelm Reset)
The Service includes AI features, including AI Coach and Overwhelm Reset.
You understand and agree:
- AI outputs may be inaccurate, incomplete, or not appropriate for your situation;
- AI outputs are not professional advice (including medical, mental health, legal, or financial advice);
- you are responsible for how you use AI outputs; and
- do not rely on AI outputs for emergencies or time-sensitive decisions where incorrect information could cause harm.
No training by Plan It Focus/Finn Advisor: We do not use your AI feature content to train our own general-purpose AI models by default.
Sensitive Information in AI Features. Please do not submit sensitive personal information (for example, payment card numbers, government identification numbers, or medical or mental health information) through AI features or other free-text fields. If you choose to include such information, you do so at your own discretion.
5) Integrations (Google Calendar, Microsoft Calendar, CalDAV)
If you connect an integration, you authorize the Service to access and process data from that provider to provide the integration features you request, including reading and writing calendar events depending on your actions.
Third-party services are governed by their own terms and policies. Plan It Focus is not responsible for third-party services.
6) Subscriptions, Billing, Cancellation, and Refunds
Some parts of the Service may require a paid subscription. Payments and subscription management are handled through Stripe Checkout and the Stripe Customer Portal.
Automatic renewal: If you purchase a subscription, it renews automatically unless you cancel.
How to cancel: You can cancel at any time online through the subscription management experience available from your account settings (which may open the Stripe Customer Portal). We do not require friction steps to cancel.
No refunds: Payments are non-refundable, and we do not provide refunds or credits for partial billing periods (for example, if you cancel in the middle of a month), except where required by law.
7) Acceptable Use
You agree not to:
- use the Service in violation of law;
- attempt to bypass security or access controls;
- interfere with or disrupt the Service; or
- use the Service to infringe or violate others' rights.
8) Accessibility and Readability Features; No Medical Claims
The Service may include optional accessibility or readability features (such as alternative fonts or display settings). These features are provided for convenience and usability. The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. We do not guarantee that any feature will produce any specific outcome for any individual.
9) Suspension, Termination, and Account Deletion
We may suspend or terminate access to the Service to protect you, the Service, or others, or to enforce these Terms.
You can request account deletion through the Service (while signed in) or through the public deletion request flow described in the Privacy Policy. When you request deletion, we revoke active sessions and mark your account as deleted so it is no longer accessible. Deletion completion may require administrative processing, and backups expire through rotation (see Privacy Policy).
10) Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11) Limitation of Liability
To the fullest extent permitted by law, Plan It Focus will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, Plan It Focus's total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to Plan It Focus for the Service in the twelve (12) months before the event giving rise to the claim; or (b) $100 USD.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
12) Indemnity
To the fullest extent permitted by law, you will indemnify and hold harmless Plan It Focus and its affiliates, and their officers, directors, employees, and agents, from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; or (b) your violation of these Terms or applicable law.
We will: (i) promptly notify you of the claim (to the extent legally permitted); (ii) allow you to control the defense and settlement of the claim; and (iii) reasonably cooperate with you, at your expense. You may not settle any claim in a way that imposes obligations on Plan It Focus without our prior written consent.
13) Governing Law; Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Except where prohibited by applicable law, you and Plan It Focus agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be brought exclusively in the state or federal courts located in Colorado, and you and Plan It Focus consent to personal jurisdiction in those courts.
Nothing in these Terms limits any rights you may have under mandatory consumer protection laws in your country or state of residence, including any right to bring claims in your local courts where required.
14) Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post updated Terms and update the Effective Date.
